Welcome to Cyqle. These Terms of Service govern your access to and use of our cloud desktop environment platform. By using Cyqle, you agree to be bound by these terms.

1. License & Scope of Use

Commercial Terms

Your access to Cyqle is governed by the following license terms that define how you may use our platform.

License Grant

Cyqle grants you a limited, non-exclusive, non-transferable, and revocable license to access and use our cloud desktop environments ("jailed environments") subject to these Terms. This license permits you to:

  • Access isolated virtual desktop sessions through our platform
  • Install and run software within the resource limits of your subscription tier
  • Store data within the allocated persistence limits of your plan
  • Use our API to programmatically manage sessions (paid tiers only)

Fair Use Policy

To ensure platform stability and fair resource allocation for all users, the following activities are strictly prohibited within your virtual desktop environment:

  • Cryptocurrency mining or proof-of-work computational tasks
  • Distributed Denial of Service (DDoS) attacks or participation in botnets
  • Excessive resource consumption that impacts other users (e.g., fork bombs, memory exhaustion attacks)
  • Running services that accept unsolicited inbound connections from the public internet for purposes other than legitimate development, testing, or authorized operations

2. Subscription & Slot Model

Billing Terms

Cyqle operates on a credit-based slot model where each active session consumes one slot. Understanding how slots work is essential to managing your account.

How Slots Work

Our platform architecture is based on a "slot" system:

  • One slot = one active desktop session running at any given time
  • Each subscription tier includes a specific number of concurrent slots
  • When you close a session, the slot becomes available for a new session

Subscription Tiers

Free Tier:

Provides limited access with 60-minute session limits, 1 vCPU, 1 GB RAM, no persistence, and low priority queue access. Intended for evaluation purposes only.

Paid Tiers (Lite, Pro, Power Tiers):

Offer extended or unlimited session durations, increased computational resources, persistent storage with retention periods, high-priority queue access, API access, and unlimited snapshots (Pro and above). Credits are consumed based on active usage time.

Billing Models

We offer two billing options for paid subscriptions. Monthly Subscription: Pay a fixed monthly price with included credit allocation that resets each billing period. Metered (Pay-as-you-go): Pay only for actual usage time with no recurring charges - buy credits as needed and credits are deducted per minute of session runtime. For both models, 1 credit equals 10 hours (600 minutes) of usage at the tier rate. You may upgrade, downgrade, or cancel your subscription at any time through your account dashboard.

3. Acceptable Use Policy

Critical Requirements

You agree to use Cyqle only for lawful purposes and in accordance with these Terms. The following activities are strictly prohibited:

Prohibited Activities

  • Illegal Activities: Using Cyqle to engage in, promote, or facilitate any illegal activity under applicable local, state, national, or international law
  • Security Bypass: Attempting to bypass, circumvent, or disable any security measures, access controls, or usage limits implemented by Cyqle
  • Unauthorized Access: Attempting to gain unauthorized access to other users' sessions, data, or Cyqle's underlying infrastructure
  • Malicious Software: Uploading, distributing, or executing malware, viruses, ransomware, or any code intended to harm others
  • Harassment & Abuse: Using the platform to harass, threaten, defame, or abuse others
  • Scraping & Automation Abuse: Using Cyqle to scrape third-party websites or services in violation of their terms of service or without authorization
  • Reselling Services: Reselling, sublicensing, or otherwise commercializing access to Cyqle without our prior written consent
  • Resource Abuse: Deliberately overloading our infrastructure or attempting to degrade service quality for other users

Enforcement

We reserve the right to investigate any suspected violations of this Acceptable Use Policy. Upon detection of prohibited activities, we may immediately suspend or terminate your account without prior notice and without refund. Serious violations may be reported to law enforcement authorities.

Important Notice

CYQLE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. Cyqle does not warrant that the service will be uninterrupted, error-free, secure, or that defects will be corrected. You acknowledge that you use Cyqle at your own risk.

Limitation of Liability Amount

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL CYQLE, ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, OR AFFILIATES BE LIABLE TO YOU FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR RELATED TO YOUR USE OF CYQLE. Our total liability to you for any claims arising from or related to these Terms or your use of Cyqle shall not exceed the total amount you paid to Cyqle in the twelve (12) months immediately preceding the event giving rise to liability. For free tier users, our liability shall not exceed $100 USD.

Third-Party Code & User Content

You are solely responsible for any code, software, scripts, or content you run, upload, or execute within your Cyqle environment. Cyqle is not responsible for any damages, losses, or legal consequences arising from third-party code, including open-source libraries, user-generated scripts, or any software you choose to install. You indemnify and hold Cyqle harmless from any claims arising from your use of third-party software or content within our platform.

5. Intellectual Property Rights

Ownership

Intellectual property ownership is clearly divided between Cyqle's platform technology and your user-generated content.

Cyqle's Ownership

Cyqle retains all right, title, and interest in and to the following:

  • The Cyqle platform, including all software, APIs, interfaces, and documentation
  • Our proprietary libp2p implementation and peer-to-peer orchestration technology
  • All trademarks, logos, and branding materials associated with Cyqle
  • Any improvements, enhancements, or derivatives of the platform made by Cyqle

Your Ownership

You retain all intellectual property rights to the content, data, code, files, and any other materials you create, upload, or generate within your Cyqle sessions. Cyqle claims no ownership rights over your user-generated content. You grant Cyqle a limited, non-exclusive license to host, store, and transmit your content solely as necessary to provide the service to you.

Data Retention & Deletion

By default, all sessions are ephemeral - data is permanently deleted upon session termination and cannot be recovered. Paid tiers (Lite, Pro, Power) include the option to enable persistence. When you choose to persist a session, your data is retained in secure storage according to your subscription tier's retention period and storage limits. Free tier sessions are always ephemeral with no persistence option. After the retention period expires, or upon account termination, all persistent data is permanently deleted. Cyqle is not responsible for data loss due to deletion according to these policies.

6. Termination

Account Closure

Either party may terminate this agreement under the following conditions:

Termination by You

You may terminate your account at any time by accessing your account settings and selecting the account closure option. Upon termination, your access to Cyqle will cease immediately. Any unused credits or prepaid subscription fees are non-refundable except as required by law.

Termination by Cyqle

We reserve the right to suspend or terminate your account immediately, without prior notice, if you violate these Terms, engage in prohibited activities under our Acceptable Use Policy, fail to pay fees when due, or if we determine that your use of the service poses a security risk to our platform or other users. We may also terminate or discontinue the service entirely with 30 days' notice.

Effect of Termination

Upon termination of your account, all data stored in your sessions will be deleted according to our data retention policy. Sections of these Terms that by their nature should survive termination (including Intellectual Property, Limitation of Liability, and Indemnification) shall survive termination.

7. Changes to These Terms

We reserve the right to modify these Terms at any time. We will notify you of material changes by posting a notice on our website or by sending you an email. Your continued use of Cyqle after such modifications constitutes your acceptance of the updated Terms. If you do not agree to the modified Terms, you must stop using Cyqle and may terminate your account.
